Hazel B. Sims (" plaintiff" ) appeals from the trial court's order granting summary judgment in favor of Graystone Ophthalmology
Associates, P.A. (" defendant" ). For the following reasons, we reverse.
The underlying facts of this case were agreed to in stipulations by the parties. These stipulations can be summarized as follows: Plaintiff was a patient of Dr. James W. Harris of defendant and was present on the premises of defendant for a vision examination on 5 November 2007. While on defendant's premises, plaintiff was seated on a rolling chair for her vision examination.
